Are you looking for a great new game that isn't hard to learn, is a ton of fun, and will make you smile while you burn through your battery? I think we've found one with Cubes vs. Spheres. The premise is super simple -- you are inside a circle in a uncomfortably white room, and cubes are rolling (as well as a 6-sided cube can roll, anyway) toward you. Your job is to keep them away by flicking balls at them. When the balls hit them, they explode is a satisfying shower of particles. If more than three cubes cross inside your circle, the game is over and you've lost.

Just because it's simple doesn't mean it's not fun as hell, though. The gameplay gets pretty frantic. There are assorted blocks that vary in how easy or hard they are to destroy (the invisible ones are rough), and you use points earned by playing to buy power-ups (exploding spheres, anyone?) to handle them all. The game physics are great. The faster you flick the balls the faster and further they fly, and the bouncing balls and blocks interact with the scenery just like you think they should. 

Most importantly, to me anyway, are the game controls. I hate games that have too many buttons and thing-a-ma-bobs to press and swipe just to play. Cubes vs. Spheres has none of that. It's simply swiping and tapping, you play it with one finger. This makes it perfect for a wide variety of devices, from a small 4-inch screen up to a full sized 10-inch tablet. Cubes vs. Spheres is just as fun on my Nexus 4 as it is on my Nexus 7, and that's something not every game can pull off.

China's complicated history with video games: when a ban isn't really a ban

Earlier this week, China Daily quoted an anonymous government source -- allegedly straight from the Ministry of Culture -- saying China is considering lifting a 12-year-old "ban" on game consoles soon. While it's was unclear how reliable the source was at the time, the Tokyo stock market sucked it up anyway, with Bloomberg observing a significant rise for Sony and Nintendo after the rumor was published. Then today we learned from Tech In Asia that Dongfang Daily followed up with two representatives from the Ministry of Culture, one of which said the department have never looked into lifting the ban, while the other person was more vague about the matter. But here's the thing: game consoles were never really banned in China. Allow us to set the record straight for you.

Donors pledge $455 million to Mali military push

ADDIS ABABA, Ethiopia (AP) ? African and Western nations on Tuesday pledged more than $450 million to fund an African-led military force to fight Islamist extremists in Mali.

Britain, meanwhile, announced that it has offered to send up to 200 military officers to help train a West African force in Mali, including up to 40 people that could be sent to Mali as part of an EU training mission of 500 personnel.

At the African Union headquarters in Ethiopia, a top official, Ramtane Lamamra, said nations had pledged $455.5 million for the United Nations-authorized, African-led Support Mission in Mali, or AFISMA. The AU says AFISMA requires an initial budget of $461 million. Additional support needed for Mali's army and the West African bloc known as ECOWAS raises the overall financial need to near $960 million.

African nations like Ethiopia, Ivory Coast, Gambia and others lined up with developed countries like the United States, Japan, Germany and the U.K. to pledge funds to the military effort. Among the pledges of assistance:

? The EU pledged 50 million euros ($67 million).

? Germany promised $20 million and a third aircraft to help transport African troops.

? Britain said it will provide a ferry to help transport equipment and French troops and will allow allies like the United States to fly refueling missions from U.K. bases.

? Japan announced $120 million in aid and support to refugees, the Kyodo news agency said.

Johnnie Carson, the State Department's top Africa official, said at the African Union gathering that U.S. assistance for the Mali effort would total $96 million. Carson said that includes $32 million previously pledged and $13 million already spent aiding military efforts.

Germany's foreign minister, Guido Westerwelle, said that despite the necessity of the military mission "in the long-term there can only be a political solution" to Mali's problems.

Islamist extremists have controlled much of northern Mali since last April. French forces began an operation earlier this month to dislodge them. A top U.S. State Department official warned on Monday that the military effort could take years to complete.

Agricultural irrigation in California's Central Valley doubles the amount of water vapor pumped into the atmosphere, ratcheting up rainfall and powerful monsoons across the interior Southwest, according to a new study by UC Irvine scientists.

Moisture on the vast farm fields evaporates, is blown over the Sierra Nevada and dumps 15 percent more than average summer rain in numerous other states. Runoff to the Colorado River increases by 28 percent, and the Four Corners region experiences a 56 percent boost in runoff. While the additional water supply can be a good thing, the transport pattern also accelerates the severity of monsoons and other potentially destructive seasonal weather events.

"If we stop irrigating in the Valley, we'll see a decrease in stream flow in the Colorado River basin," said climate hydrologist Jay Famiglietti, senior author on the paper, which will be published online Tuesday, Jan. 29, in the journal Geophysical Research Letters. The basin provides water for about 35 million people, including those in Los Angeles, Las Vegas and Phoenix. But the extra water vapor also accelerates normal atmospheric circulation, he said, "firing up" the annual storm cycle and drawing in more water vapor from the Gulf of Mexico as well as the Central Valley.

When the additional waves of moisture bump into developing monsoons, Famiglietti said, "it's like throwing fuel on a fire."

He and colleague Min-Hui Lo, a postdoctoral researcher at the University of California Center for Hydrologic Modeling who is now at National Taiwan University, painstakingly entered regional irrigation levels into global rainfall and weather models and traced the patterns.

"All percent differences in the paper are the differences between applying irrigation to the Central Valley and not applying it," Famiglietti said. "That's the point of the study ? and the beauty of using computer models. You can isolate the phenomenon that you wish to explore, in this case, irrigation versus no irrigation."

Famiglietti's team plans to increase the scope of the work to track how major human water usage elsewhere in the world affects neighboring areas too. A better understanding of irrigation's impact on the changing climate and water availability could improve resource management in parched or flooded areas.

Remedies available to California identity theft victims | legaldocspro ...

The remedies available to California identity theft victims under the law is the topic of this blog post. The California statutes relating to several of the remedies available for a victim of identity theft are contained in Civil Code Sections 1798.92-1798.97.

Another remedy available is that identity theft may be asserted as a partial or total affirmative defense to any lawsuit based in whole or in part on unauthorized charges made to a credit card, or other account.

In other words if the underlying debt is partially or entirely the result of identity theft, then the victim of identity theft has a valid defense to the portion of the charges that were unauthorized, and to any resulting interest or fees related to the charges.

There are other remedies available under the California Civil Code, for example, a victim of identity theft may sue affirmatively and seek injunctive relief in the form of a finding that the individual does not owe a debt.

Note that the first thing a person who is the victim of identity theft should do is file a police report immediately as soon as they realize that they have been victimized by identity theft. This is required in order to utilize the remedies in California. They should also send a written notice to the creditor attempting to collect the debt based on the unauthorized charges.

Specifically anyone who has been served with a lawsuit based on a debt or claim based in whole or in part on unauthorized charges made to a credit card, or other account due to identity theft may file a cross-complaint against the person suing them and ask the Court for affirmative relief that the individual does not owe a debt.

The law in California, specifically California Civil Code ? 1798.93[c](5), requires the victim of identity theft to provide you with a written notice at least 30 calendar days before filing any cross-complaint seeking their actual damages, attorney fees, and any other equitable relief as the Court deems appropriate.

The written notice places the creditor so notified, under a legal duty to take diligent steps to investigate the claim of identity theft. If they fail to do so, and the victim can show clear and convincing evidence that they failed to do so after being properly notified, the victim is entitled to a civil penalty of up to $30,000.00 in addition to any other damages pursuant to California Civil Code ? 1798.93[c](6).

Civil Code ? 1798.93 provides the statutory authorization for the filing of a cross-complaint to establish that a person is a victim of identity theft in connection with the claim being asserted against them by any creditor, which shall be established by a
a preponderance of the evidence.

Civil Code ? 1798.95 states in part that, ?The Court has continuing jurisdiction for 10 years from the filing of the original action in order to join related causes of action and defendants based upon the theft of the same person?s identity, the Court may also extend the jurisdiction over the matter if good cause is shown.?
The cross-complaint or any joinder of a defendant should be brought within 4 years of the date that the victim of identity theft, knew, or should have known of the identity theft. See Civil Code ? 1798.96.

The remedies that are discussed here are cumulative to the rights and remedies provided under other laws, and they do not restrict any legal actions against the person who perpetrated the identity theft. See Civil Code ? 1798.97.

WASHINGTON (AP) ? President Barack Obama says his picks for two top posts will crack down on those whose irresponsible behavior threatens the U.S. economy and the middle class.

In his weekly radio and Internet address, Obama praises his nominee to lead the Securities and Exchange Commission, Mary Jo White, and his pick for the Consumer Financial Protection Bureau, Richard Cordray.

Obama says White, a former federal prosecutor, will help reform Wall Street. He says Cordray will be a champion for American consumers and is imploring the Senate to confirm him.

Obama installed Cordray last year through a recess appointment after Senate Republicans opposed his nomination.

In the Republican address, South Dakota Sen. John Thune says the Senate must pass a budget that addresses out-of-control spending to stave off another credit-rating downgrade.

Obama expresses support in call with France's Hollande

WASHINGTON (Reuters) - President Barack Obama spoke to French President Francois Hollande by phone on Friday and expressed support for France's military intervention in Mali, the White House said in a statement.

"The two leaders emphasized the need to rapidly establish the African-led International Support Mission in Mali, as well as the importance of the Interim Government of Mali establishing a political roadmap that will lead to elections and restoration of democratic governance," the statement said.

"President Obama and President Hollande condemned last week's terrorist act in Algeria and affirmed their mutual commitment to countering terrorism more broadly in North Africa," it said.

France sent troops and aircraft to its former colony two weeks ago to block a southward offensive by Islamists occupying Mali's north.

Rumble in the Wall St jungle: Ackman, Icahn duke it out on TV

NEW YORK (Reuters) - Two of the most prominent investors in the world, Carl Icahn and Bill Ackman, had Wall Street mesmerized on Friday as years of acrimony exploded into a bruising verbal scrap on live TV.

Initially CNBC was only talking to Ackman, but then the cable TV station put Icahn on as well and all hell broke loose.

The argument centered on nutritional supplements company Herbalife Ltd , in which Ackman has had a well-publicized short position that Icahn has slammed.

Icahn, 76, who has gone from feared corporate raider to activist investor in more than three decades of dealmaking, called Ackman, 46, a "liar" and "the most sanctimonious guy I ever met in my life."

In a tirade that included expletives, Icahn said he would never invest with Ackman and predicted investors in his Pershing Square hedge fund would lose a lot of money on the Herbalife bet. U.S. news outlets have reported that Icahn has a long position in Herbalife, although he has not confirmed that.

Ackman, who is usually much more restrained than Icahn when speaking publicly, got in a few verbal shots himself. Icahn "does not have a good reputation" and "is not an honest guy," he said.

The altercation quickly became the talk of the financial world, both on trading floors and on Twitter.

"I will never delete today's Ackman vs Icahn CNBC debate from my DVR. Even when DVRs are like Betamaxes, I'll force my grand kids to watch," tweeted Eric Jackson of hedge fund Ironfire Capital LLC.

Business Insider Deputy Editor Joseph Weisenthal tweeted: "It's never going to get any better than what we just saw."

The influential blog ZeroHedge called it the "Ultimate Hedge Fund Deathmatch: Icahn And Ackman As The Real Billionaire Husbands Of CNBC Going Wild."

BusinessInsider held an online poll: "Who Won The Brawl Between Carl Icahn And Bill Ackman?" As of 5 p.m. New York time, 70 percent of the more than 1,800 people who voted declared Ackman the victor.

Neither Ackman nor Icahn could be reached for comment after the CNBC show.

Ackman has called Herbalife a "well managed pyramid scheme" that he predicted will collapse. Herbalife has denied the allegation.

"On CNBC today, Mr. Ackman continued to misrepresent Herbalife," an Herbalife spokeswoman said on Friday.

"Herbalife is a financially strong and successful company, having created meaningful value for shareholders, significant opportunities for distributors and positively impacted the lives and health of our consumers over our 32-year history."

DECADE-OLD DISPUTE

The genesis of their feud stems from a nasty contractual dispute involving a real estate company deal 10 years ago, when Ackman was running his former hedge fund, Gotham Partners, which he co-founded in 1993 with former Harvard Business School classmate David Berkowitz.

After eight years of litigation, a court ruled in Ackman's favor and Icahn was forced to pay Gotham $4.5 million, plus interest.

Indeed, the discussion on CNBC often had little to do with the merits of Ackman's view of Herbalife. At times, Icahn also feuded with CNBC host Scott Wapner, accusing him of "bullying" him when he was pressed on whether he had gone "long" on Herbalife shares.

Icahn may have little to lose from the dustup given that he is simply managing his own money these days. Ackman, on the other hand, manages about $11 billion at Pershing Square, including money from many prominent institutional investors.

Herbalife shares briefly surged over 5 percent when Icahn said during the row that Ackman, by going public with his big short position, would cause the "mother of all short squeezes" in the stock.

A short squeeze is when short sellers are forced to cover their position, a move that pushes a stock higher.

Ackman and Icahn's dislike of each other is well known in financial circles. Some of the tension stems from the fact they both specialize in the same game - taking big positions in companies and agitating for management changes.

Ackman's bet against Herbalife is also being challenged by another big hedge fund player, Third Point manager Daniel Loeb, who has said he holds a big long position on the stock.

FAA probes pilot who nearly clipped man in stunt

Two New Jersey men sued Subway this week, claiming the world's biggest fast-food chain has been shorting them by selling "footlong" sandwiches that measure less than 12 inches.

The suit, filed Tuesday in Superior Court in Mount Holly, N.J., might be the first legal filing aimed at the Milford, Conn.-based company since a Subway customer in Australia posted a photo of a "footlong" sub next to a ruler on the company's Facebook page to allege that the sandwich was not as long as advertised.

The photo quickly spread across the Internet and the company has since been on the receiving end of a barrage of criticism.

Stephen DeNittis, the lawyer for the plaintiffs in the New Jersey suit, said he's seeking class-action status and is also preparing to file a similar suit in Pennsylvania state court in Philadelphia.

He said he has had sandwiches from 17 shops measured, and every one came up short. The lawsuit claims it is a "deceptive practice for Subway to advertise its large sandwich as a 'footlong.'"

"When you add this up over time, that comes out to be anywhere between 45 to 60 cents a sandwich over the course of six years," DeNittis said of the alleged shortchanged subs.

Subway has 38,000 stores around the world, nearly all owned by franchisees. Its $5 "footlong" specials have been a mainstay of the company's ads for five years.

DeNittis said both plaintiffs - John Farley of Evesham, N.J., and Charles Noah Pendrack of Ocean City, N.J. - came to him after reading last week about the short sandwiches.

The lawsuit seeks compensatory damages and a change in Subway's practices. The company should either make sure its sandwiches measure a full foot or stop advertising them as such, according to the suit.

In response to the original photo on Facebook that unleashed the wave of complaints, Subway Australia posted a statement clarifying that "footlong" subs were just a trademark, not reality.

"'SUBWAY FOOTLONG' is a registered trademark as a descriptive name for the sub sold in Subway Restaurants and not intended to be a measurement of length," read a comment posted to Subway Australia's Facebook page Jan. 16.

Prior to that statement, the company had told ABCNews.com that the size discrepancy was caused by the fact that the bread was baked fresh in each of the company's 38,000 restaurants around the world.

"We are committed to providing a consistent product delivering the same amount of bread to the customer with every order," the statement read. "The length however may vary slightly when not baked to our exact specifications. We are reinforcing our policies and procedures in an effort to ensure our offerings are always consistent no matter which Subway restaurant you visit."

In response to the lawsuit, the head baker for Subway reiterated their commitment to 12 inches with each "footlong" sub.

"If proper procedures are followed, they will all measure 12 inches," Mark Christiano told ABC News.

Mary Jo White, Obama Pick to Head SEC, Pushed Former Enforcement Chief As Bank Lawyer

Morgan Stanley needed someone with an inside line to the Securities and Exchange Commission. It was 2005, and the investment banking giant's board of directors was hearing that its top candidate for CEO could be implicated in a probe of insider trading at a major hedge fund. Seeking clarity, the board engaged the lawyer many considered the best in the business: Mary Jo White.

White swiftly lived up to her reputation, setting Morgan Stanley's board at ease. According to a report later prepared by the Senate Finance Committee, she emailed and then spoke by phone with the agency's chief of enforcement and learned that the board's CEO choice, John Mack, was most likely in the clear. The SEC investigation -- which had seemed to be leading closer to Mack -- disappeared, and Mack took the helm at Morgan Stanley.

On Thursday, President Obama tapped White to run the SEC as its next commissioner, a powerful role as Wall Street's top regulator and cop. If she is confirmed by Congress, the agency will have at its helm a well-respected attorney who won high-profile cases against mobsters, terrorists and financial fraudsters over the course of nearly a decade as the U.S. attorney for Manhattan.

The agency would also gain a powerful defense lawyer, one who has represented many of the biggest names on Wall Street -- including former Bank of America chief Ken Lewis -- in cases before the SEC.

As the Mack case shows, White was not afraid to push the SEC to get what she wanted. While there is no evidence that White behaved improperly, the episode is an example of what critics often deride as a too-cozy relationship between regulators and defense attorneys, and it almost certainly will be raised by Congress during White's confirmation hearing. These relationships are often further bolstered by the common practice of lawyers moving -- as White will do, if confirmed -- between jobs advocating for Wall Street and jobs policing it.

"This is nothing more than a continuation of the revolving door," said Larry Doyle, the managing partner at the independent advisory firm DM Income Advisers, in Connecticut. Doyle said White's nomination diminishes already weakened public trust and confidence in the system.

Although other critics share Doyle's broad view that the SEC is too close to the industry it polices, many of those who have been toughest on the agency in the past applauded Obama's selection. White's reputation as a fair and independent prosecutor, they said, make her perfect for the job. Moreover, several noted, she worked in private practice before she became a U.S. attorney, and her reputation there is sterling.

"Mary Jo White was a tough, smart, no nonsense, broadly experienced and highly accomplished prosecutor," Dennis Kelleher, president and CEO of Better Markets, a nonprofit group, said in a statement. "She knew who the bad guys were, went after them and put them in prison when they broke the law. That?s what must happen if integrity and investor confidence is to be restored in our securities markets."

New York Attorney General Eric Schneiderman, who hasn't been afraid to buck the Obama administration in the past, also praised White's nomination. "She is a tough, experienced prosecutor, which is exactly what the SEC needs right now to restore investor confidence," Schneiderman said in a statement.

William McLucas, chair of the securities department at Washington-based law firm WilmerHale, worked alongside White in the 1990s when he served as director of enforcement at the SEC. He praised White and said her status as a Wall Street insider in the latter part of her career would be a public benefit.

"It adds to your perspective. It adds to your understanding. It lends a greater depth and a greater breadth of wisdom to your capacity to serve as a chairman," he said. Looking to benefit those in the industry is "just not the way people like Mary Jo White would approach the job and conduct themselves. She's a public servant first."

White first emerged on the national scene in 1993, when President Clinton appointed her U.S. attorney for the Southern District of New York, one of the highest-profile jobs for a federal prosecutor. On her watch, the office reeled in a series of big wins, securing convictions against the mastermind behind the 1993 bombing of the World Trade Center and against mobster John Gotti. Her proteges at the office include Robert Khuzami, who recently stepped down as the SEC's enforcement chief, and Patrick Fitzgerald, who successfully prosecuted two former Illinois governors as U.S. attorney in Chicago.

After she returned in 2002 to Debevoise & Plimpton, the law firm where she worked early in her career, White put together one of the best teams of white-collar lawyers in the country. In recent years, the firm has often defended those accused of wrongdoing during the financial crisis.

As an experienced litigator with deep knowledge of law enforcement, White, who has her own spokesman at Debevoise, is often sought out by reporters for her views on financial crime. In Interviews, she has characterized of the origins of the financial crisis in ways that put her at odds with many financial reform advocates who have pushed the Obama administration to bring more cases against bank executives. Its possible those views could complicate her selection to head the SEC.

"The financial crisis was so expensive and so many people were injured that one's instinct is to think that there must have been massive wrongdoing from the top on down," she told The Huffington Post in September. But criminal cases must be built on compelling evidence, not suppositions, and evidence of broad-based misconduct that would rise to that level doesn't exist, White said. She made similar statements on behalf of clients.

"Some have looked to assign blame for every aspect of the financial crisis, even where there is no evidence of misconduct," she wrote in a motion defending Bank of America's Lewis in 2010. She referred to then-New York Attorney General Andrew Cuomo's charges against the former bank chief as "a badly misguided decision without support in the facts or the law."

In addition to big-name clients like Lewis, White also became known over the last decade as the lawyer companies hire to conduct an internal investigation -- a probe into possible misdeeds. Many such investigations are never made public.

The Morgan Stanley matter likely would have stayed behind closed doors, too, but for accusations made by a former SEC attorney that the insider-trading investigation into Mack was killed for political reasons. That claim led to hearings by the Senate Finance Committee, and, in 2007, a report critical of how the agency handled the investigation.

In June of 2005, according to the report, White emailed Linda Thomsen, then head of the SEC's enforcement division. The subject line: "URGENT."

Thomsen later testified that she didn't divulge any information about the insider-trading case. That account, however, contradicts what White wrote in talking points used to brief Morgan Stanley's board, according to the Senate committee. Those notes indicate that Thomsen told White there was "smoke" regarding Mack's involvement in the alleged illegal trading, but "surely not fire."

The implication: Thomsen told White more about the status of the case than she let on. Four days after the phone call, Morgan Stanley hired Mack. Soon after, the SEC ended its investigation.

In congressional testimony, Robert Hanson, one of the SEC supervisors working on the case, said Assistant Director Mark Kreitman had told him he knew about the call between White and Thomsen.

"Kreitman also said that it is a little out of the ordinary for Mary Jo White to contact Linda Thomsen directly, but that White is very prestigious and it isn't uncommon for someone prominent to have someone intervene on their behalf," Hanson said.

That such a conversation was "not uncommon," the Senate committee said in its report, "is precisely the problem."

Gary Aguirre, the SEC attorney whose complaints prompted the Senate probe, accused the agency of refusing to pursue Mack because of his "very powerful political connections," an account that emails from Aguirre's former supervisor confirmed, the committee concluded.

In an interview with The Huffington Post on Wednesday, Aguirre said he believes the White phone call to Thomsen also played a role in killing the SEC's investigation into Mack. "There?s no question in my mind that that phone call from Mary Jo White stopped the whole investigation," he said. "The case was like a railroad heading for a criminal investigation. And it got zapped with a call."

The Senate report was also critical of Paul Berger, a current Debevoise partner who at the time of the insider-trading investigation was a senior supervisor in the SEC's enforcement division. In 2005, Berger reached out through a friend to White to mention his interest in joining the private firm. The report criticized Berger for not immediately recusing himself from the Mack investigation when Morgan Stanley hired Debevoise. "When initially questioned, Berger?s answers concerning his employment search were less than forthcoming," the report concluded.

Berger, who later joined Debevoise as a partner, did not respond to a request for comment Thursday.

The Senate report found the SEC "squandered [an] opportunity through a series of missteps" to fully investigate the insider-trading case, but it did not conclude that White's phone call led to the agency dropping the case, nor did it suggest that she behaved inappropriately.

White also did not respond to a request for comment on Thursday, but other defense lawyers said her actions during the course of the Mack case were entirely appropriate. Pushing for information about a matter of interest to a client is a lawyer's job, they said.

"It shows that she is nothing less than an exceptionally skilled litigator," said Ralph Ferrara, a Washington securities attorney who has known White more than 20 years. "She should have knocked on that door hard. That [the SEC] opened it is on them, not her."

Wolfram Alpha expands Facebook analytics, takes a closer look at your social relationships

Have you ever wanted to know if you're the most popular amongst your group of friends? Or which of your pals lives the furthest from you? These are questions that can't be answered by Facebook's latest Graph Search, but they're perfect for the stats geeks over at Wolfram Alpha. The group started mining Facebook for data last year, but have recently expanded its analytics to include a closer look at your social relationships. Namely, they've identified five "network roles:" social insiders, outsiders, neighbors, gateways and connectors. Insiders share the same friends while outsiders don't, neighbors don't have a lot of buddies outside of your network while gateways do, and connectors are those that bridge two networks together, like a college buddy who went to the same high school. Combined with location, age and other info, this data unlocks an array of potential visualizations color-coded by different categories, letting you see patterns you might not have noticed before. If you think the analysis ends there, think again; by enabling a "Historical Analytics" feature, you'll be allowing Wolfram Alpha to continually collect your info so you can see how your Facebook profile changes over time.
