STILL No Duty to Disclose Material Adverse Conditions in Florida ...

The recent case of Thomas J. Duggan, LLC v. Peacock Point, LLC,[i] reminds us of several important principles of the law of fraud and misrepresentation in Florida, as applied to commercial real estate transactions.? First, not every false statement concerning a material fact about real property made by a seller to a buyer gives rise to liability on the seller?s part; (2) the law in Florida remains caveat emptor (?let the buyer beware?) in commercial transactions; that is, subject to a few narrow exceptions, a seller has no implied duty to disclose material adverse conditions affecting real property, be they ever so egregious, and (3) an ?as is? clause in a commercial real estate contract powerfully reinforces a seller?s defenses against liability claims based on undisclosed conditions.? None of these principles are really new, but, like most fundamentals, they bear re-emphasizing.

The facts in the Peacock Point case concerned a seller who, according to the court, mistakenly believed that it had accomplished everything necessary to obtain the immediate issuance of building permits for new home construction on six waterfront lots in a Destin, Florida subdivision. ?In June, 2007, the seller entered a contract to sell the lots to a buyer who apparently forgot the first rule of real estate development: ?take nothing for granted.?? The court found that one of the seller?s representatives represented to the buyer that building permits were immediately available.? Unfortunately, the City of Destin subsequently refused to issue building permits until after a certificate of completion for the entire development had been issued.? This was apparently a problem, perhaps because expensive work on the subdivision remained to be performed.? Thus, in 2008, the buyer sued to rescind the contract, alleging that the seller misrepresented the facts regarding the availability of building permits.? The facts are intuitively appealing from the buyer?s perspective, and one might even have expected a win for the buyer under one of several attractive theories.

But the law doesn?t always bear out our intuition, as we see in this case. ?Although the seller?s representative ?believed, albeit mistakenly,? that the lack of a certificate of completion didn?t prevent the immediate issuance of building permits for the lots in the subdivision, the trial court had found that the false representation was not a knowing one.? The seller?s representative actually believed the false statement was true.? Thus, the court concluded, the statement couldn?t serve as the basis for a claim of fraud by the buyer, which is an intentional tort requiring knowledge of falsity to create liability for the seller.

But wait, argued the buyer, even if the seller?s representative didn?t know that the statement was false, couldn?t it serve as the basis for a claim of negligent misrepresentation?? After all, Florida courts have long held that even innocently made misrepresentations can justify rescinding a contract (the court mentioned Held v. Trafford Realty Co.[ii] for this proposition).? Perhaps so, reasoned the court, but only if the buyer didn?t know the representation was false, the falsity was not obvious to the buyer, and the seller had ?superior knowledge of the condition of the property.?? However, in the Peacock Point case, the trial court had already concluded that the seller did not possess superior knowledge concerning the property, finding that ?Mr. Duggan [the buyer] is a sophisticated developer and so he certainly had a great deal of knowledge regarding developments.?? Thus, out goes the negligent misrepresentation claim as a ground for rescission of the contract.

The buyer?s attack on the seller was struggling, but not yet finished.? The buyer next argued that when the buyer?s president asked the seller whether the lots had ?all city approvals and if they were ?buildable?, and the seller, through its agent, answered affirmatively, such ?disclosure? by the seller triggered a further duty on the seller?s part to disclose the lack of a certificate of completion for the subdivision.? The buyer?s counsel was clearly aware of the long-standing rule in Florida that sellers of commercial property, unlike sellers of residential property,[iii] have no duty to disclose known material adverse conditions.? Thus, the buyer?s only hope of breaching the seller?s caveat emptor defense lay in arguing that the facts of its case fell within an exception to the general rule.? This narrow exception, mentioned in two earlier Florida appellate cases,[iv] states that even a commercial real estate seller, who has no duty to disclose, must disclose the whole truth germane to any material facts the seller does disclose concerning the property, in order to make the facts disclosed not misleading.

But again the buyer?s argument in Peacock Point fell short.? Not only were both the parties in the Peacock Point case sophisticated parties and able to discover the whole truth for themselves, the previous Florida cases discussing the exception to the caveat emptor rule did not involve contracts that contained strong ?as is? provisions, such as the one now before the court.? The ?as is? clause in the Peacock Point contract disclaimed, in substance, all express or implied representations or warranties? of any kind regarding the property (including habitability, design, quality, merchantability, condition, environmental status, matters of survey, or fitness for any particular purpose).? Moreover, the ?as is? provision stated that the buyer had conducted such investigations of the property as it deemed necessary or appropriate and would rely upon such investigations.

Therefore, the court concluded, citing an earlier DCA case with approval, ?a sophisticated purchaser of commercial property who agreed to an ?as is? purchase contract, had ample opportunity to conduct inspections, and could have discovered an alleged defect through exercise of ordinary diligence, may be disgruntled, but does not have a cause of action in fraud.?? By the way, the ?as is? clause not only eliminated any seller duty to disclose, but, according to the court, shifted the risk of a ?mutual mistake? of fact (i.e., that building permits were immediately available for the lots) onto the buyer, thus destroying the buyer?s final argument for rescission of the contract based on a mutual mistake of fact, and ending its chances for success on appeal.

What do we learn from this grim tale of a buyer ?who may be disgruntled, but does not have a cause of action in fraud???? First, material representations and warranties by a seller of real estate are no substitute for thorough investigations prior to closing, particularly if the buyer is a sophisticated party capable of conducting it, and even more so if the contract contains a strong ?as is? clause.? Second, the doctrine of caveat emptor is alive and well in Florida commercial real estate transactions, subject to some troublesome exceptions that make prediction of the outcome in a given case difficult.

Nanomedicine: Bringing brighter light into living bodies

ScienceDaily (July 18, 2012) ? Fluorescent nanoparticles loaded with organic light-emitting dyes are expected to transform live-animal imaging technologies. Compared to inorganic quantum dots, these optically stable materials are non-toxic and can easily be modified with functional groups, making them ideal when targeting specific tissues in the body. Unfortunately, traditional dyes have been known to aggregate and lose their emission intensity when incorporated in nanoparticles at high concentration.

To overcome this problem, a team of researchers led by Bin Liu and Ben Zhong Tang at the A*STAR Institute of Materials Research and Engineering have now designed a family of dyes with enhanced fluorescence upon aggregation.

At the heart of the traditional dyes is a planar chromophore called triphenylamine-modified dicyanomethylene, which emits red light in dilute solutions but fluoresces weakly when aggregated. "The close vicinity of the chromophores induces fluorescence quenching due to non-radiative pathways," says Liu.

Liu, Tang and their team reversed this phenomenon by attaching propeller-shaped tetraphenylethene pendants to each extremity of the chromophore. Contrary to planar compounds, the shape of the propellers prevents strong stacking interactions between chromophores, blocking the aggregation-caused quenching process. In addition, the physical confinement prevents these propellers from rotating freely, enabling light emission.

The team formulated the dyes using a bovine serum albumin (BSA) matrix -- a biocompatible and clinically used polymer -- and evaluated their performance as probes. Experimental characterization showed that the wavelength of the emission maximum of the nanoparticles remained unchanged upon encapsulation and that the intensity of the emitted light increased with the dye loading.

Live imaging of breast cancer cells revealed that the nanoparticles displayed more intense and homogeneously distributed red fluorescence in the cytoplasms (see image) than free aggregates, suggesting that BSA boosted the cellular uptake of the dyes. The team also found that the nanoparticles were optically stable in biological media and displayed good biocompatibility.

The researchers intravenously injected the nanoparticles in liver-tumor-bearing mice for in vivo imaging studies. They found that unlike free aggregates, the nanoparticles selectively accumulated in the tumor, clearly highlighting the cancerous tissue in the animals. "This demonstration underscores new research opportunities to explore similar diagnostic probes with potential clinical applications," says Liu.

The team is currently investigating near-infrared emissive biological probes for targeted in vivo tumor imaging applications. The nanoparticles can also be utilized to understand cancer metastasis or the fate of transplanted stem cells. "These probes are promising in multimodal imaging applications through integration with magnetic resonance imaging or nuclear imaging reagents," says Liu.

Microsoft gives a tease of Office of Windows Phone 8, talks up Office 2013 integration

Microsoft may have told us a lot about Windows Phone 8 in June, but it left out much of what the Office component's update would entail. Thankfully, Partner Group program lead John Jendrezak has voluntered to let us peek under the hood, including our first real glimpse of the new Office Hub. The app's connection to Office 2013 is more than the skin deep looks you see here: Office documents will sync more seamlessly from desktop to phone, and it's implied that the reading position sync from the desktop version will extend to the mobile realm as well. Many mysteries still remain as to what's exactly different in the more pocketable version of Office. There's more about the new work suite's communion with the cloud at the source link, however, so dig in if an offline Office feels like a prison.

Sprint fires up new wireless data network

(AP) ? Sprint Nextel Corp. said Monday that it has turned on its new wireless data network, providing a much-needed boost to the carrier, whose data speeds lag those of its largest competitors.

Sprint fired up the fourth-generation, or 4G, network in Atlanta, Dallas, Houston, Kansas City, San Antonio and some smaller surrounding cities on Sunday. It uses LTE, or Long-Term Evolution, technology already in use by Verizon Wireless and AT&T Inc.

Four smartphones and one mobile-hotspot device are capable of using the network.

PC Magazine got early access to the network a month ago, and found that it's not quite as fast as Verizon's and AT&T's equivalents, but a big step up from Sprint's older 3G, or third-generation, network and the 4G access it rents from Clearwire Corp.

Sprint, the third-largest U.S. cellphone carrier, doesn't have as much available spectrum, or space on the airwaves, as the larger carriers do. That holds back its LTE speeds somewhat.

Verizon and AT&T also have much wider coverage on their LTE networks. Verizon covers 304 markets, or two-thirds of the U.S. population.

Sprint, which is based in Overland Park, Kan., is planning to expand LTE coverage this year and largely complete the network buildout next year. It's planning to supplement its own LTE network with that of Clearwire, which has yet to fire up.

Sprint had said that Baltimore would also be among the first cities to get LTE, but it was missing from the initial lineup.

Bomb threat shuts crossing between Detroit and Canada -- again

Authorities shut down one of the busiest bridge crossings between Canada and the United States on Monday evening after receiving a bomb threat, according to Dan Stamper, president of the Detroit International Bridge Company.

?We take any threat very seriously, and set in motion the security measures the bridge has had in place since 9/11, staying in constant contact with first responders,? Stamper said in a statement. ?We cannot confirm, but suspect, that this has something to do with Canada's disinvestment at the border by cutting back on customs' agents.?

The bridge reopened around 1 a.m. Tuesday. No device was found, WDIV-TV reported.

The bridge closing comes four days after a man called from a street pay phone, making a similar threat to a nearby commuter tunnel that also connects Detroit to Windsor, Ontario, in Canada, The Associated Press reported. No explosives were found and the call was determined to be a hoax, according to the Detroit Free-Press.


Monday night?s bomb threat was called in around 7:20 p.m. Authorities immediately stopped traffic on the bridge.?

Nanodevice builds electricity from tiny pieces

ScienceDaily (July 11, 2012) ? A team of scientists at the National Physical Laboratory (NPL) and University of Cambridge has made a significant advance in using nano-devices to create accurate electrical currents. Electrical current is composed of billions and billions of tiny particles called electrons. They have developed an electron pump -- a nano-device -- which picks these electrons up one at a time and moves them across a barrier, creating a very well-defined electrical current.

The device drives electrical current by manipulating individual electrons, one-by-one at very high speed. This technique could replace the traditional definition of electrical current, the ampere, which relies on measurements of mechanical forces on current-carrying wires.

The key breakthrough came when scientists experimented with the exact shape of the voltage pulses that control the trapping and ejection of electrons. By changing the voltage slowly while trapping electrons, and then much more rapidly when ejecting them, it was possible to massively speed up the overall rate of pumping without compromising the accuracy.

By employing this technique, the team were able to pump almost a billion electrons per second, 300 times faster than the previous record for an accurate electron pump set at the National Institute of Standards and Technology (NIST) in the USA in 1996.

Although the resulting current of 150 picoamperes is small (ten billion times smaller than the current used when boiling a kettle), the team were able to measure the current with an accuracy of one part-per-million, confirming that the electron pump was accurate at this level. This result is a milestone in the precise, fast, manipulation of single electrons and an important step towards a re-definition of the unit ampere.

As reported in Nature Communications, the team used a nano-scale semiconductor device called a 'quantum dot' to pump electrons through a circuit. The quantum dot is a tiny electrostatic trap less than 0.0001 mm wide. The shape of the quantum dot is controlled by voltages applied to nearby electrodes.

The dot can be filled with electrons and then raised in energy. By a process known as 'back-tunneling', all but one of the electrons fall out of the quantum dot back into the source lead. Ideally, just one electron remains trapped in the dot, which is ejected into the output lead by tilting the trap. When this is repeated rapidly this gives a current determined solely by the repetition rate and the charge on each electron -- a universal constant of nature and the same for all electrons.

The research makes significant steps towards redefining the ampere by developing the application of an electron pump which improves accuracy rates in primary electrical measurement.

Masaya Kataoka of the Quantum Detection Group at NPL explains: "Our device is like a water pump in that it produces a flow by a cyclical action. The tricky part is making sure that exactly the same number of electronic charge is transported in each cycle.

The way that the electrons in our device behave is quite similar to water; if you try and scoop up a fixed volume of water, say in a cup or spoon, you have to move slowly otherwise you'll spill some. This is exactly what used to happen to our electrons if we went too fast."

Stephen Giblin also part of the Quantum Detection Group, added: "For the last few years, we have worked on optimising the design of our device, but we made a huge leap forward when we fine-tuned the timing sequence. We've basically smashed the record for the largest accurate single-electron current by a factor of 300.

Although moving electrons one at a time is not new, we can do it much faster, and with very high reliability -- a billion electrons per second, with an accuracy of less than one error in a million operations.

Using mechanical forces to define the ampere has made a lot of sense for the last 60 or so years, but now that we have the nanotechnology to control single electrons we can move on.

The technology might seem more complicated, but actually a quantum system of measurement is more elegant, because you are basing your system on fundamental constants of nature, rather than things which we know aren't really constant, like the mass of the standard kilogram."

Acupressure is an ancient Chinese medicine derived from acupuncture. Before you start:

1. At waist level, place the knuckles of both hands in your back and hold a pressure here for about 1 minute. This maneuver can be done sitting on a chair or by lying down on the ground.

2. Wrap your hands around your waist placing your thumbs in your back at about 4 finger lengths away from the spine. Once you have found this spot, apply pressure for about 1 minute.

3. Take 2 fingers and place them horizontally beneath the naval. Below these 2 fingers directly under the navel you will find your next spot. Press into this area while talking deep breaths. Work it for about 1 minute.

4. Place your knuckles half way between the base of the buttocks and the top of the hip bone about 4 fingers lengths away from the spine. Move your fingers to work the area for about 2 minutes.

5. Finish by pulling your knees in towards your chest. Hold this position for about 1 minute.

The answer is, in part, that the first migrants already blocked the exits. The original departure from Africa was less a migration than it was an expansion... individuals tended to live in roughly the area they were born, and it was only the ever-growing population numbers that drove the advancing wave of modern humans through Asia and Europe generation after generation. The modern humans had a strong advantage (probably language) over the archaic hominids already occupying the new lands, but the human population in Africa had no such advantage over their brethren once the first wave spread out past the Red Sea. Hence, the migration out of Africa appears to have been a one-time event of the type you so quickly derided as nonsense.

House Republicans didn?t just uphold the first half of their ?repeal and replace? mantra for President Obama?s signature health-care reform legislation Wednesday.?They voted to repeal the measure amid a hail of rhetorical fire and brimstone, hollering one of their chief November rallying cries before a 244-to-185 vote with but five Democrats joining a united Republican front.?

For Republicans, that?s about half the point.

As they battle toward the November elections, congressional Republicans aren?t going to lay out a specific, unified proposal for replacing Obama?s health-care legislation. Instead, they will allow individual members to run on the ideas they think are best. Then, with the election in the rearview mirror, conservatives expect that they?ll be able either to repeal or to reopen discussion of the health-care law because of its impact on the nation?s finances.

And that?s when they?ll really get back into the fray with specific proposals.

For now, however, the GOP playbook works like this. First, cite your principles.

?What we?ve said is we believe in the principles that Americans hold dear as it relates to health care,? said Rep. Tom Price (R) of Georgia at a health-care discussion on Tuesday sponsored by Republican groups Crossroads GPS and American Action Network. Twitter makes changes to iPhone, Android apps

New versions of the Twitter app?are available for iPhone and Android phones, with the short-messaging blog noting that they offer "several updates to bring you closer to everything you care about."

That includes expanded tweets, something that Twitter began offering on its desktop version last month.

"Since we?introduced expanded Tweets?on twitter.com, we?ve added several new partners like?MLB?and?C-SPAN?to a diverse and growing list of media sources,"?Sung Hu Kim, Twitter's product manager?for mobile, wrote on the company's blog.

Now, using Twitter apps for iPhone and Android, when you tap on a tweet linking to a Kickstarter project, he wrote, you can "play its video directly from the Tweet details view in your app." You can also read article summaries when you tap tweets linked to sources like magazines,?or view images and video?when you expand tweets linked to sites like Etsy and Vimeo.

Twitter also says it has made "major improvements?in?search autocomplete?so that you will see more suggestions when you search for people. As before, you can search for real names or @usernames before you complete your query."

There is also support for push notification for tweets for those folks you follow whenever they send a new tweet or retweet. All you have to do is turn on push notification for that person using the "action button" on their profile; you edit all notifications in your account settings on your phone.

Another added feature, this one for iPhone users but not Android, is?being able to find the "best tweets and photos for events experiences like?twitter.com/#NASCAR on your iPhone. Now, Twitter for iPhone complements any live event, whether you?re watching from home or from the stands."

DAYTONA BEACH, Fla. (AP) ? There was no fire or rain. Still, another frantic finish at Daytona International Speedway.

Tony Stewart emerged the winner, charging past Daytona 500 winner Matt Kenseth on the last lap and holding on as the challengers stacked up behind him Saturday night in one of Daytona's trademark wrecks.

"I don't even remember what happened that last lap," Stewart said.

Stewart has 18 victories at Daytona, second only to the late Dale Earnhardt's 34 wins.

None of Stewart's wins are in the Daytona 500, though. Stewart is 0 for 14 in NASCAR's biggest race of the year and was a non-factor in February, when the race was delayed a day by rain and then stopped more than two hours for a massive jet dryer fire.

"I wish I could trade a couple of these races in for just one Sunday race in February," he said of the Daytona 500.

But he's always strong in the summer race at Daytona, and this visit was no different.

Stewart qualified second but dropped back to 42nd at the start of the race because his time was thrown out by NASCAR after his Chevrolet failed inspection. He quietly rode around ? which is his style at restrictor-plate races ? and let Roush Fenway Racing teammates Kenseth and Greg Biffle control the front.

"We were going to try to win the thing and be there at the end," Biffle said. "We were right there."

The Roush drivers thought they had the field covered ? Kenseth led a race-high 89 laps and Biffle led 35 ? and they probably still liked their chances on the final green-white-checkered restart. Kenseth was the leader with Biffle on his bumper, as second-place Stewart was lined up with Kasey Kahne.

Kenseth and Biffle pulled away for a lap, but Stewart came quick on the outside, moved to the front, then crossed down the track in front of Kenseth for the lead. Seconds later, Biffle seemed to wiggle in traffic and cars began wrecking all over the track in what was tallied to be a 15-car accident.

"I'm not really sure what happened, they just started wrecking behind us," said Kenseth, who started from the pole in his bid to become the first driver since 1982 to sweep the two Daytona races in the same season.

"It seems like we always end these things in green-white-checkers, and whenever you do, really anybody that's in the front few tandems has a shot to win the thing. It's so unpredictable. You do things those last two laps that you'd never do the rest of the race. It's really hard to figure. You sit out there and ride around and be leading the whole race and come down to one of the green-white-checkers and have no idea where you're going to finish."

The final results showed Jeff Burton came from nowhere to finish second in a Richard Childress Racing Chevrolet, followed by Kenseth in a Ford and Joey Logano in a Toyota.

Stewart teammate Ryan Newman, who was involved in a pit road incident with Kahne and Jeff Gordon, finished fifth. Roush driver Carl Edwards was sixth and was followed by Kahne, Brad Keselowski in a Dodge and Michael Waltrip. Bobby Labonte rounded out the top 10.

Denny Hamlin, who battled a bad back all weekend, raced for the win late but was involved in an accident that dropped him to 25th.

"I could have done without it, that's for sure," said Hamlin, who added none of the on-track contact was too rough. "I'll be 100 percent by next weekend, for sure."

Biffle, who was in third on the final restart, dropped all the way to 21st and said the accident started when Dale Earnhardt Jr. gave Kevin Harvick a big push, and Biffle turned in front of Harvick.

"He got a hell of a shove off the front of Junior ... I'm like, 'It's impossible that somebody could get into that hole that quick,'" Biffle said. "But he got squirted off the bumper of (Earnhardt) and shot in there. It was my fault."

Roughly 90 minutes before the race, NASCAR announced AJ Allmendinger had been suspended for failing a random drug test taken last week at Kentucky. Penske Racing rushed Sam Hornish Jr. in from North Carolina, where he was in the middle of a live television show, to drive Allmendinger's car. Hornish arrived just minutes before it was time to climb in the car.

"All the way up until the plane took off we didn't know if we were going to make the race in time," Hornish said. "I said that I would tell the pilot to fly faster, but I'm pretty sure that he was going to have the throttle pinned the whole way down."

Hornish said he grabbed a sandwich and tried to hydrate as much as I could. I think I drank 18 bottles of water knowing how hot it was down here."

He was doing an admirable job until a tire problem caused him to spin, bringing out the first caution just past the halfway point. Hornish finished 33rd, and Penske officials said they'll meet this week with Allmendinger to get a better understanding of the situation.

"We just cut down a tire and it came apart and tore the car all up," Hornish said. "I'm disappointed for the guys."

Stewart, meanwhile, picked up his third win of the season, which ties him for the most in the Sprint Cup Series with Keselowski. The defending series champion has won this race at Daytona four times in his career, all within the last eight years.

The victory made the three-time champion feel much better his chances to defend his title because Stewart feels he has enough wins to ensure a spot in the Chase for the Sprint Cup championship.

"It's not a guarantee, but it's nice to know we've got those three wins," he said. "I would think (the Chase) would be a virtual lock that we have those wins. Hopefully, we won't have to use them."

Pakistan shuns physicist linked to 'God particle' because of religious beliefs

ISLAMABAD - The pioneering work of Abdus Salam, Pakistan's only Nobel laureate, helped lead to the apparent discovery of the subatomic "God particle" last week. But the late physicist is no hero at home, where his name has been stricken from school textbooks.

Praise within Pakistan for Salam, who also guided the early stages of the country's nuclear program, faded decades ago as Muslim fundamentalists gained power. He belonged to the Ahmadi sect, which has been persecuted by the government and targeted by Taliban militants who view its members as heretics.

Their plight ? along with that of Pakistan's other religious minorities, such as Shiite Muslims, Christians and Hindus ? has deepened in recent years as hardline interpretations of Islam have gained ground and militants have stepped up attacks against groups they oppose. Most Pakistanis are Sunni Muslims.

Salam, a child prodigy born in 1926 in what was to become Pakistan after the partition of British-controlled India, won more than a dozen international prizes and honours. In 1979, he was co-winner of the Nobel Prize for his work on the so-called Standard Model of particle physics, which theorizes how fundamental forces govern the overall dynamics of the universe. He died in 1996.

Salam and Steven Weinberg, with whom he shared the Nobel Prize, independently predicted the existence of a subatomic particle now called the Higgs boson, named after a British physicist who theorized that it endowed other particles with mass, said Pervez Hoodbhoy, a Pakistani physicist who once worked with Salam. It is also known as the "God particle" because its existence is vitally important toward understanding the early evolution of the universe.

Physicists in Switzerland stoked worldwide excitement Wednesday when they announced they have all but proven the particle's existence. This was done using the world's largest atom smasher at the European Organization for Nuclear Research, or CERN, near Geneva.

"This would be a great vindication of Salam's work and the Standard Model as a whole," said Khurshid Hasanain, chairman of the physics department at Quaid-i-Azam University in Islamabad.

In the 1960s and early 1970s, Salam wielded significant influence in Pakistan as the chief scientific adviser to the president, helping to set up the country's space agency and institute for nuclear science and technology. Salam also assisted in the early stages of Pakistan's effort to build a nuclear bomb, which it eventually tested in 1998.

Salam's life, along with the fate of the three million other Ahmadis in Pakistan, drastically changed in 1974 when parliament amended the constitution to declare that members of the sect were not considered Muslims under Pakistani law.

Ahmadis believe their spiritual leader, Hadhrat Mirza Ghulam Ahmad, who died in 1908, was the Promised Messiah _ a position rejected by the government in response to a mass movement led by Pakistan's major Islamic parties. Most Muslims consider Muhammad the last prophet and those who subsequently declared themselves prophets as heretics.

All Pakistani passport applicants must sign a section saying the Ahmadi faith's founder was an "impostor" and his followers are "non-Muslims." Ahmadis are prevented by law in Pakistan from "posing as Muslims," declaring their faith publicly, calling their places of worship mosques or performing the Muslim call to prayer. They can be punished with prison and even death.

Salam resigned from his government post in protest following the 1974 constitutional amendment and eventually moved to Europe to pursue his work. In Italy, he created a centre for theoretical physics to help physicists from the developing world.

Although Pakistan's then-president, general Zia ul-Haq, presented Salam with Pakistan's highest civilian honour after he won the Nobel Prize, the general response in the country was muted. The physicist was celebrated more enthusiastically by other countries, including India.

Despite his achievements, Salam's name appears in few textbooks and is rarely mentioned by Pakistani leaders or the media. By contrast, fellow Pakistani physicist A.Q. Khan, who played a key role in developing the country's nuclear bomb and later confessed to spreading nuclear technology to Iran, North Korea and Libya, is considered a national hero.

Officials at Quaid-i-Azam University had to cancel plans for Salam to lecture about his Nobel-winning theory when Islamist student activists threatened to break the physicist's legs, said his colleague Hoodbhoy.

"The way he has been treated is such a tragedy," said Hoodbhoy. "He went from someone who was revered in Pakistan, a national celebrity, to someone who could not set foot in Pakistan. If he came, he would be insulted and could be hurt or even killed."

The president who honoured Salam would later go on to intensify persecution of Ahmadis, for whom life in Pakistan has grown even more precarious. Taliban militants attacked two mosques packed with Ahmadis in Lahore in 2010, killing at least 80 people.

"Many Ahmadis have received letters from fundamentalists since the 2010 attacks threatening to target them again, and the government isn't doing anything," said Qamar Suleiman, a spokesman for the Ahmadi community.

For Salam, not even death saved him from being targeted.

Hoodbhoy said his body was returned to Pakistan in 1996 after he died in Oxford, England, and was buried under a gravestone that read "First Muslim Nobel Laureate." A local magistrate ordered that the word "Muslim" be erased.

If you find yourself constantly straying from a project to check email, update a Facebook status, or play a game, this app may eliminate distractions?if you adhere to what it's attempting to accomplish.

The Focus Booster Experience
Focus Booster uses the Pomodoro Technique, a time management method created by Francesco Cirillo. The technique dissects work into 25-minute sections known as "pomodoros" that are separated by 5-minute breaks. Focus Booster uses that as its base, but serves up some user-specific flexibility. You can alter the work blocks to a length more to your liking (as well as the break times), activate a ticker that sounds as time passes, and set alarms to alert you when you're at the end of a work.?

Clicking the start button begins the countdown and should you activate the ticking sound effect, you'll hear that, too. Focus Booster also fills its thin, black, rectangular body with a colored bar that serves as a visual representation of how much time has passed. The bar starts as green, but turns golden yellow as the time limit draws near. You can't, unfortunately, alter the bar's colors.? I would have preferred the bar to turn red as a sign that time's running out.

That's a small gripe, but I have a larger one: Focus Booster doesn't loop. It proceeds from work to break, but doesn't circle back around and automatically begin playing the work portion again; you need to manually activate it. This means that you have a second break to get involved in all manner of shenanigans if you don't immediately hit the button again to keep the flow. That said, Focus Booster, by default, lives on top of all other apps you open, so it's somewhat hard to ignore.?

Time After Time
If you're an OS X user who wants an app to nudge you in the right direction, Focus Booster will do the job nicely. Focus Booster lacks a feature?auto-loop?that would've made it more useful to those of us who are easily distracted, but even as is, it's a capable free solution.

Daughters of Demi Moore: Done with Mama Drama!


Demi's Moore ex-husband is hooking up with Mila Kunis. But that's not the worst news facing this actress these days.

According to Radar Online, Moore's daughters - Scout, Rumer and Tallulah, the latter of whom is caught in a naked photo scandal - are giving their mother the silent treatment. How come?

They don't want to "deal with the drama" anymore, this anonymous insider claims.

Ever since Moore and Kutcher split, Demi has reportedly grown extra needy, acting more like a "sister" than a mother. Adds the mole of the three siblings:
